Jon states: “Your most recent charge, which was filed too late for the March membership meeting, will be heard by the membership in April. The person against whom the allegations are being levied, as well as the membership, are entitled to receive all of the material you submitted not just those pages you identified (3 pages out of 7 total). If you do not want the entirety of your submission circulated to Sister Fox and the membership you must withdraw it and re-submit only those pages you do want circulated.”
My comment: In section 22.3 on page 114 of our Constitution it does state that at least five (5) signatures are required for the filing to be presented to the membership. The Constitution does not state that the members who sign it are accusing or filing the charges. It only states that they are members in good standing. You want to treat them as accusers when I am the only accuser.
In section 21.7 on page 104 of our Constitution it clearly states “No officer or member of the L.U. shall furnish to any unauthorized person a list of the names and addresses of the membership." You have already released it once and it found its way to HR and you are ready to release it again. I will continue to state that you are violating our constitution by doing so.
I do not understand the need to release member’s names to the member being charged. When a preferring of charges is created the filer shows and asks members in good standing for approval to present it to the membership. Usually the member’s that sign it do not have any supportive documents of their own and the only thing they can testify about is what the filer told and presented to them and that they signed it. The ONLY reason to release these names in such a manner is to intimidate the members or future members from signing other preferring of charges. You tell me any other reason why it is so important to release the names of the members who signed. What other information do they have to offer?
Page 1 is a cover letter to the union, pages 2 and 3 are identical to pages 6 and 7, page 4 is the signature page and page 5 is the cover letter to Ellen Fox. If page 4 is released to any unauthorized person it will be a clear violation of section 21.7 on page 104 of our Constitution. You are our President and that will be your responsibility.
